Terms of Service

The SmartWatermark service is published by Tajalys Inc., a corporation registered in New Brunswick (Canada), BN 745798231NP0001, registered office: 80 Mapleton Road Unit 11-84, Moncton, NB, E1C 7W8. Contact: contact@smartwatermark.app.

Purpose: SmartWatermark is a tool for applying watermarks to digital images. SmartWatermark operates on a 'Zero-Knowledge' architecture. Original and processed files never leave the user's device. Tajalys Inc. does not collect, store or transmit any image or metadata.

Pro license: the Pro license is a one-time purchase of $29 USD (excluding applicable taxes). Taxes are automatically calculated by Stripe Tax. The license is personal, non-transferable and valid for the commercial lifetime of the product.

As-is Clause & Hardware limitations: Tajalys Inc. provides the software 'as is' and does not guarantee the absence of bugs. Because image processing runs locally, Tajalys Inc. disclaims all liability for browser crashes (Out of Memory) or processing failures caused by the hardware limitations of the user's device (insufficient RAM or CPU). The user is solely responsible for backing up original images before processing.

Refund policy: all purchases of the Pro license are final. No refunds are granted after activation. Exception for European Union residents: under Directive 2011/83/EU, you have 14 days to request a refund if the service has not been executed. Processing your first image through the tool initiates the execution of the digital service and results in the irrevocable loss of your right of withdrawal, which you expressly acknowledge upon purchase.

Payment: payments are processed by Stripe, Inc. Tajalys Inc. does not have access to your banking data. In case of a payment dispute, contact us at contact@smartwatermark.app.

Acceptable use: you agree not to use SmartWatermark to watermark images for which you do not hold the copyright. The GPS removal tool (EXIF Shield) must not be used to erase authorship of a third party's work.

Intellectual property: SmartWatermark (source code, algorithms, interface) is the property of Tajalys Inc. The user retains full rights to their images.

Limitation of liability: to the fullest extent permitted by law, Tajalys Inc. shall not be liable for any direct, indirect or consequential damages resulting from the use or inability to use the service, including loss of data or revenue. Tajalys Inc.'s total liability is strictly limited to the amount paid by the user for the Pro license within the last 12 months.

Termination: Tajalys Inc. reserves the right to suspend the Pro license, without notice or refund, in the event of technical abuse (reverse-engineering, security bypass) or a proven violation of these terms.

Governing law: these terms are governed by the laws of New Brunswick and Canada. Any dispute shall be subject to the exclusive jurisdiction of the courts of Moncton, NB. For EU consumers, mandatory provisions of their national consumer law remain applicable.

Changes: Tajalys Inc. reserves the right to modify these terms. Continued use of the service after changes constitutes acceptance.
