Terms of Service

The SmartWatermark service is published by Tajalys Inc., a corporation registered in New Brunswick (Canada), BN 745798231NP0001, registered office: 80 Mapleton Road Unit 11-84, Moncton, NB, E1C 7W8. Contact: contact@smartwatermark.app.

Purpose: SmartWatermark is a tool for applying watermarks to digital images. SmartWatermark operates on a 'Zero-Knowledge' architecture. Original and processed files never leave the user's device. Tajalys Inc. does not collect, store or transmit any image or metadata processed through the application. Tajalys Inc. provides the software 'as is' and does not guarantee the absence of bugs or interruptions.

Pro license: the Pro license is a one-time purchase of $29 USD (excluding applicable taxes). Taxes (GST/HST for Canada, VAT for the European Union) are automatically calculated by Stripe Tax based on your country of residence. The license is personal, non-transferable and valid for life for the purchaser.

Refund policy: all purchases of the Pro license are final. Given the nature of the digital good, no refund is granted after the license has been activated. Exclusive exception for residents of the European Union: in accordance with EU Directive 2011/83/EU, you have 14 days to request a refund if and only if the license has not been used. Using the tool constitutes an express waiver of this right.

Payment: payments are processed by Stripe, Inc. Tajalys Inc. does not have access to your banking data. In case of a payment dispute, contact us at contact@smartwatermark.app.

Acceptable use: you agree not to use SmartWatermark to watermark images for which you do not hold the copyright. The GPS removal tool (EXIF Shield) is designed to protect your privacy and must not be used to erase authorship of a third party's work.

Intellectual property: SmartWatermark, its source code, interface and brand are the property of Tajalys Inc. The user retains full rights to their images. Tajalys Inc. claims no rights over content processed by the application.

Limitation of liability: to the fullest extent permitted by law, Tajalys Inc. shall not be liable for any direct, indirect or consequential damages resulting from the use or inability to use the service, including loss of data or revenue. The total and cumulative liability of Tajalys Inc. to the user, for any claim related to the service, is strictly limited to the amount actually paid by the user for the purchase of the Pro license.

Termination: Tajalys Inc. reserves the right to suspend or revoke the Pro license, without notice or refund, in the event of a proven violation of these terms of service.

Governing law: these terms are governed by the laws of the Province of New Brunswick and the federal laws of Canada applicable therein. Any dispute shall be subject to the exclusive jurisdiction of the courts of Moncton, New Brunswick, Canada. For consumers residing in the European Union, mandatory provisions of their national consumer law remain applicable.

Changes: Tajalys Inc. reserves the right to modify these terms. Any changes will be posted on this page with an updated date. Continued use of the service after changes constitutes acceptance.
